About this deal

The whereabouts of all family members was examined to help develop a timeline of what happened. This is routine during all murder investigations and nobody else was considered a suspect. Terry Mullins, in addition to being a leading Polygraph Expert, is a man of integrity, which I witnessed for myself when a professional football player attempted to manipulate his results after taking a test. I have no doubt whatsoever that if he had suspicions about Luke or his mother’s test he would have spoken out. Instead, Terry Mullins describes Luke Mitchell as a “victim” and stands by that statement and the results of the mother and son’s tests completely.

I have, until now, chosen to ignore the personal comments posted here, on the grounds that they are of no bearing on the discussions at hand. This latest post, however, leaves me no option but to respond. Mr Middleton was acquitted. Forensic science was found in the above mentioned case after sixteen years, yet we are expected to believe that a child, with no criminal or forensic knowledge, was able to frenziedly murder his girlfriend, mutilate her body, enter his house covered in blood and other forensics, clean up, burn clothes including a parka coat, in less than an hour, and not a trace of DNA or forensics were ever found. It’s impossible. Shane later admitted on the stand he had discussed his earlier statement with his mother before telling police Mitchell had been at home. He admitted that the statement was not accurate. As the alibi was not held up in court, Corrine was arrested for perjury, however prosecutors made a decision not to proceed with the charges. However Billy Middleton states: " They then threw in a charge of sexual abuse against my wife instead but both she and her uncle proved in court it was not physically possible because we were about 60 miles apart at the time and the doctor who examined her testified that there was no physical evidence to support it. Andrina Bryson was not an independent witness. She and her family were friends with the Jones and Walker families. She claimed she did not know the Jones family.DNA and forensic science have improved dramatically from 10 spikes in 2003, to 16 spikes in 2022, and the science is much more accurate. There are samples in the case, that if re-examined, could definitively prove who the murderer is. But the reporter parrots Dalkeith CID’s first impression of Luke Mitchell sometime later at Newbattle school: “He also showed no emotion at the horrifying sight.” This was a Dalkeith CID officer’s hunch and is the sole ‘evidence’ against Luke Mitchell yet spun as ‘facts’.

Two other witnesses also identified Mitchell as the young man they had seen at the Newbattle end of the path around 50 minutes later. SCOTT FORBES: Lust killers aren’t satisfied with just the murder, they have to mutilate or use the corpse in a posing fashion. This all fit with the murder of Jodi. To cut the breast away or mutilate it is also an indication of the “cutting away” of the relationship with the mother, a ‘mummy’s boy’ wanting to free himself.

The Habré trial has proceeded satisfactorily to date. There have been no serious breaches of fair trial rights and the court-appointed lawyers are defending the accused competently and ensuring the adversarial nature of proceedings. Reading their first statements, in comparison to their latter ones, you could be forgiven for thinking that the statements were from different people. They had changed so drastically, and all in favour of the police theory. He himself describes the charge as "sexual abuse". I'm unclear why. As far as I know the charges were of sexual assault. To my mind sexual abuse indicates a more long term situation. A freudian slip, perhaps?. Maybe this was closer to the truth of what was happening in Billy and Kareen's relationship. Why didn’t Joseph Jones and Alan Ovens, who were less than a three-minute walk away from Roan’s Dyke Path, where the search party started, offer to assist? Instead, they permitted an old woman and a young girl go out at night into woods/fields to look for Jodi. That doesn’t seem right. A Forensic Medicine Report completed in October 2004 spoke of the “sexually motivated homicide” and agreed with the FBI findings that the post-mortem injuries reflected “piquerism”…”that is to say, gaining sexual pleasure from cutting and stabbing”.

Jodi Jones’ DNA was found on a pair of trousers belonging to Luke Mitchell. The trousers were in a holdall at his father’s house in Livingston, a home he hadn’t been to for at least a fortnight prior to the murder of Jodi. The evidence was, therefore, deemed irrelevant and agreed to be dismissed. Discrepancies in witnesses’ statements pertaining to an incident years, or even months before, are NOT perjury. A material effect on the outcome of the trial would have to have transpired for perjury to have occurred. Two other witnesses also identified Mitchell as the young man they had seen at the Newbattle end of the path around 50 minutes later. To add insult to injury, the DNA on the ‘hoodie’ found on Lady Path which wasn’t tested, could have identified James Falconer much earlier, or if the police had asked who lived in the house when they interviewed Falconer’s brothers and mother, this matter could have been closed much earlier.

Briefings

After reading the charges, the judges began to call witnesses to the stand. The first witnesses gave contextual evidence—the historical, social, political, economic, and cultural situation of Chad before and during the Habré regime. These witnesses also outlined the psychological profile of the defendant and described his political career from his first struggles to his fall in December 1990. The EAC judges also called expert witnesses to the stand. These mainly comprised forensic pathologists, ballistics experts, statisticians, and legal experts. The EAC judges then began to hear from direct and indirect victims. These witnesses gave testimony about the specific crimes they experienced or witnessed. The case was now at a stage where forensic scientists, forensic pathologists, polygraph experts, crime scene managers, senior detectives, lawyers, QCs, Advocates, and the FBI were all saying Luke Mitchell was wrongly convicted of the heinous crime of murder. Terry Mullins concluded: “I’m certain of the test result. Its absolute. I can’t believe that Luke Mitchell was convicted on the evidence presented”. He also showed no emotion at the horrifying sight.” This is simply untrue and gives you an idea of the standards and tactics used by the media to paint a horrible picture.

With all due respect I find it mind boggling how people can continue to support a complete shambles ( not my words, the liaison officer who gave evidence) of an investigation. I note you fail to mention that Mr Middleton set up an organisation to help other wrongly accused people, www.wronglyaccusedperson.org.uk and has devoted himself to that organisation since being acquitted. I was honoured to be asked to join that organisation, and am proud to be part of it.

Several people were questioned extensively by police and ruled out including most of the people mentioned in the documentary.
