His two brothers were murdered. Dalton was pardoned after serving 14 years in prison for the offense.

During a gun battle with law enforcement and locals, four members of the gang were killed. Emmett Dalton was shot 23 times and suffered severe injuries, but he lived. He was tried, found guilty, and given a life sentence in the Kansas prison at Lansing. He received a pardon from the state governor after fourteen years.
